Understanding your rights and responsibilities as a concessionaire

Introduction

Welcome to Lupon Water District's Terms and Conditions. These terms govern your use of our water services, online platforms, and all related services provided by Lupon Water District (LWD). By accessing or using our services, you agree to be bound by these terms.

These terms were last updated on June 15, 2023 and may be updated periodically. Continued use of our services after changes constitutes acceptance of the new terms.

1. Service Agreement

By applying for water service, you enter into a contractual agreement with Lupon Water District subject to these terms and applicable laws.

1.1 Application Process

  • All applications are subject to approval based on service availability and applicant eligibility
  • Applicants must provide accurate and complete information
  • False information may result in service denial or termination

1.2 Service Activation

  • Service begins after application approval and payment of required fees
  • Standard activation occurs within 3-5 business days
  • Emergency activations may be available for additional fees

2. Water Service Terms

These terms govern the provision and use of water services to your property.

2.1 Billing and Payments

  • Bills are issued monthly and due within 15 days of issuance
  • Late payments incur a 2% monthly interest charge
  • Service may be disconnected after 30 days of non-payment
  • Reconnection requires payment of all outstanding balances plus reconnection fees

2.2 Water Usage

  • Water is for domestic use only unless commercial use is approved
  • Unauthorized commercial use may result in penalties
  • Tampering with meters is prohibited and may result in legal action

2.3 Service Interruptions

  • LWD may interrupt service for maintenance, repairs, or emergencies
  • We endeavor to provide advance notice for planned interruptions
  • No bill adjustments for planned service interruptions under 12 hours

3. Responsibilities

Both LWD and concessionaires have specific responsibilities under this agreement.

3.1 LWD Responsibilities

  • Provide safe, potable water meeting national standards
  • Maintain water distribution infrastructure
  • Respond to service interruptions and emergencies
  • Provide accurate billing and customer service

3.2 Concessionaire Responsibilities

  • Pay bills promptly and in full
  • Protect water meter and service connection from damage
  • Report leaks, meter issues, or service problems immediately
  • Provide access for meter reading and maintenance
  • Notify LWD of address or contact information changes

4. Prohibited Activities

The following activities are strictly prohibited and may result in service termination or legal action.

  • Tampering with or bypassing water meters
  • Unauthorized connections to LWD infrastructure
  • Water theft or fraudulent use
  • Damaging LWD property or infrastructure
  • Using water for illegal activities
  • Providing false information on applications or service requests

5. Dispute Resolution

Process for resolving disputes related to water service.

5.1 Billing Disputes

  • Disputes must be filed in writing within 15 days of bill receipt
  • Service continues during dispute resolution
  • If dispute is resolved in your favor, adjustments will be made to your account

5.2 Service Complaints

  • Complaints should be filed through official channels
  • We aim to respond within 3 business days
  • Unresolved complaints may be escalated to the LWUA

6. Privacy and Data Protection

How we collect, use, and protect your personal information.

  • We collect personal information necessary for service provision
  • Information may be shared with government agencies as required by law
  • We implement security measures to protect your data
  • You may request access to your personal information we hold

7. Liability and Limitations

Limitations of LWD's liability under this agreement.

  • LWD is not liable for damages caused by events beyond our control
  • We are not responsible for property damage from service interruptions
  • Concessionaires are responsible for internal plumbing maintenance
  • LWD's liability is limited to direct damages up to one month's average bill

Acceptance of Terms

By using Lupon Water District services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
